FACE Act Fight

The DOJ has filed at least twenty-six charges under the FACE Act in 2023. A fight is underway to repeal this Act.

The Souls and Liberty Action Network is mobilizing to help in the effort to repeal the FACE Act. 


In 1994 President Clinton signed and enacted the FACE Act, which stands for Federal Access to Clinic Entrances Act. 


In short, the FACE Act exists to prohibit the use of force, threats or physical obstruction to injure, intimidate or interfere with someone's ability to access reproductive health services. Convictions can result in imprisonment and fines. 


No other act of civil disobedience is targeted in this way.


The justification of such action is based on the grounds that abortion is a constitutional right. However, in 2022 the Supreme Court reversed that decision in the Dobbs vs. Jackson ruling.


The FACE Act is further questioned as all crimes under it are already prohibited through federal law, state law or local ordinances.


Additionally, the Act includes protections for churches and other houses of worship.


Recently, the Biden administration has used the FACE Act to prosecute peaceful, pro-life activists as is evident in the arrest and conviction of the Garland 9. The longest sentence for one of these individuals is 57 months.


The DOJ has filed at least twenty-six charges under the act in 2023.


Conversely, since the Dobbs opinion, there have been a minimum of 108 Catholic churches and 78 pregnancy resource centers attacked. Only three FACE Act cases have been filed in response, and the DOJ has yet to prosecute anyone for obstructing church or house of worship access.
